SECTION 1 - OVERVIEW

This website is operated by Slack Tide Hammocks, a business operated by Christopher Hauk, located at 419-1600 Stroulger Rd, Nanoose Bay, BC V9P 9B7, Canada. Throughout the site, the terms "we", "us" and "our" refer to Slack Tide Hammocks. By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including the policies referenced herein. These Terms apply to all users of the site. Please read them carefully before using our website; if you do not agree to all of these Terms, you may not access the website or use any services. SECTION 2 - ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your province, state or territory of residence, or that you have given us consent to allow your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction in using the Service. You must not transmit any worms, viruses or code of a destructive nature. A breach of these Terms may result in immediate termination of your access to the Service. Except with our prior written permission, you agree not to purchase products through the Service for commercial resale, and not to misuse the Service, including bulk purchasing intended to circumvent the per-batch quantity limits described in Section 3.

SECTION 3 - PRODUCTS AND PRE-ORDERS

Our products are handmade by artisan makers. Because each item is woven and finished by hand, natural variations in colour, weave, texture and dimensions may occur; such variations are a normal characteristic of handmade goods and are not defects. We make every effort to display product colours and images accurately, but cannot guarantee your monitor's display of any colour will be accurate.

Certain products are offered as pre-orders. Items marked as pre-order are charged at checkout, are produced in capped batches, and ship within the shipping window stated on the product page. Quantities for each batch are limited, and an item may become unavailable once a batch has sold out. If a pre-order batch ships more than 14 days past the ship window stated on the product page, you may cancel the affected pre-order for a full refund, including any shipping charges paid, by contacting us. We reserve the right to limit the quantities of any products we offer, and to discontinue any product at any time.

SECTION 4 - PRICING, BILLING AND ORDER ACCEPTANCE

All prices are shown in Canadian dollars (CAD) unless otherwise stated, and do not include shipping charges or applicable taxes, which are calculated and shown at checkout where applicable. Prices are subject to change without notice; a price change will not affect an order already confirmed. You agree to provide current, complete and accurate purchase and account information for all purchases, and to promptly update your information so we can complete your transactions and contact you as needed. We reserve the right to refuse any order, or to cancel an order, at our discretion, including orders that appear to involve fraud, misuse of the Service, or quantity abuse. If we cancel an order after payment has been taken, we will notify you using the contact information provided with the order and refund the amount paid.

SECTION 5 - SHIPPING AND RETURNS

Shipping methods, delivery estimates and shipping charges are governed by our Shipping Policy, and returns, exchanges and refunds are governed by our Returns Policy, each as published on this site. Those policies form part of these Terms, and you should review them before placing an order.

SECTION 6 - THIRD-PARTY TOOLS AND LINKS

We may provide access to third-party tools over which we neither monitor nor have any control or input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties or endorsement, and that we shall have no liability arising from or relating to your use of optional third-party tools. Third-party links on this site may direct you to websites not affiliated with us; we are not responsible for their content or accuracy, and we do not warrant and will not have any liability for any third-party materials, websites, products or services.

SECTION 7 - USER COMMENTS, REVIEWS AND SUBMISSIONS

If you send us comments, reviews, photographs, ideas or other submissions (collectively, "comments"), you agree that we may, at any time and without restriction, edit, publish and otherwise use in any medium any comments you forward to us, and that we are under no obligation to keep comments in confidence, to pay compensation for them, or to respond to them. You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy or other proprietary rights, and will not contain libellous or otherwise unlawful, abusive or obscene material, or any computer virus or malware. You may not use a false email address or pretend to be someone other than yourself. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive or otherwise objectionable, or that violates any person's intellectual property rights or these Terms.

SECTION 8 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service is inaccurate, at any time without prior notice, including after you have submitted your order. If an error affects an order you have placed and the order is cancelled as a result, we will notify you and refund the amount paid.

SECTION 9 - PROHIBITED USES

In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose or to solicit others to perform unlawful acts; (b) to violate any international, federal, provincial or state regulations, rules, laws or local ordinances; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, defame, intimidate or discriminate; (e) to submit false or misleading information; (f) to upload or transmit viruses or other malicious code; (g) to collect or track the personal information of others; (h) to spam, phish, spider, crawl or scrape; or (i) to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

We do not guarantee that your use of the Service will be uninterrupted, timely, secure or error-free, or that results obtained from the Service will be accurate or reliable. In no case shall Slack Tide Hammocks, its operator, or its suppliers be liable for any indirect, incidental, punitive, special or consequential damages of any kind, to the fullest extent permitted by applicable law, arising from your use of the Service or of any product purchased through the Service.

SECTION 11 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Slack Tide Hammocks and its operator, Christopher Hauk, together with our suppliers and service providers, from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

These Terms, and any separate agreements whereby we provide you the Service, shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes. Changes apply to orders placed after the change takes effect.
